"Gunning For a Change: The Court Takes Aim At The Second Amendment" posted by ~Ray
Posted on 2008-03-26 06:32:08

They are simple words-“ the alter of the people to keep and bear arms shall not be infringed”-that liberal commentators have called “maddeningly ambiguous,” even while justifying constitutional rights (like privacy) that go unnamed in the Constitution. Yet for all of the controversy surrounding gun hold back laws the Second Amendment has not been considered by the U. S. Supreme act in nearly 70 years. All of that is about to dress as the highest court in the arrive announced recently that this spring it ordain review the inspect of the first federal appellate opinion to overturn a gun hold back law on the ground that the Second Amendment protects individual rights. A decision will likely be issued by early summer set against the backdrop of a heated 2008 presidential campaign. For decades. Americans in command and legal scholars in particular have argued about gun hold back laws and the meaning of the back up Amendment which states “A well regulated militia being necessary to the security of a free express the alter of the people to keep and bear arms shall not be infringed.” Did the Framers intend to protect an individual right to feature arms or is this amendment an anachronism intended to provide for long-defunct state militias but rendered meaningless today? For years the liberal press and academia undergo argued that not only is the Second Amendment an embarrassing relic from a bygone age but that truly enlightened jurists should just cancel the thing substituting judicial whim for the democratic process of consider and legislative deliberation. They put forth anti-gun rights “scholarship” desire the 2000 book by Emory University historian Michael Bellesiles which “proved” that gun ownership was never a study part of American society and that America’s “gun grow” is based on nothing more than a myth (which begs the question- what did the pioneers used to settle the frontier? Harsh language?) Bellesiles’ work became the darling of the liberal establishment winning rave reviews from ’s ban on guns nine federal appeals courts had rejected this individual rights theory. But in doing so legal scholars and judges undergo tried to engage in a certain degree of intellectual dishonesty or at the very least intellectual inconsistency. The same minds capable of interpreting the Constitution to find the most elusive of “rights” never envisioned by the Framers seem perfectly willing to overlook plain language when it doesn’t conform to their socio-political agenda. Justice Alex Kozinski of the U. S. Court of Appeals for the 9 “Judges know very well how to read the Constitution broadly when they are sympathetic to the right being asserted. We undergo held without much ado that ‘speech or…the touch’ also means the Internet [for First Amendment purposes] and that ‘persons houses papers and effects’ also means public telecommunicate booths [for Fourth Amendment purposes]. When a particular right comports especially well with our notions of good social policy we build magnificent legal edifices on elliptical constitutional phrases…But…when we’re none too keen on a particular constitutional pledge we can be equally ingenious in burying language that is incontrovertibly there. It is wrong to use some constitutional provisions as springboards for major social dress while treating others desire senile relatives to be cooped up in a nursing home until they quit annoying us…. Expanding some to … gargantuan proportions while discarding others desire a crumpled gum wrapper is not faithfully applying the Constitution; it’s using our cater as federal judges to furnish our personal preferences.” (emphasis added) If liberal scholars interpreted the Second Amendment the way they construed the rest of the account of Rights we would undergo law professors arguing in favor of mandatory gun ownership. And why should the D. C. Circuit’s opinion come as such a surprise anyway? The Second Amendment is contained in the Bill of Rights- the divide of our Constitution that deals exclusively with individual liberties. As if this point needed greater emphasis the Amendment itself refers explicitly to “the right of the people.” The act’s 58 summon opinion finds additional support in the Framers language: by pointedly guaranteeing a right to “keep” arms as come up as to “feature” them. Justice Silberman says our Founding Fathers chose a term implying ownership or possession of a functioning weapon by an individual for private use. In writing for the act’s majority. Silberman convincingly argues that the Framers fresh from the depose of the British monarchy saw the back up Amendment as a way of codifying a natural alter to private use of firearms for not just putting food on the family delay but also defending against the “depredations of a tyrannical government.” As with so many of the issues tackled by the Supreme Court the displace vote next move could come drink to Justice Anthony Kennedy. If the justices reject the D. C. Circuit’s position that there is an individual right to gun ownership then the District of Columbia’s ban and presumably other federal state and local gun-control measures will remain intact. The Court might also act a partial stance- adopting the individual rights view but nevertheless upholding the D. C ban as a reasonable public safety measure. But the possible outcome that has many observers monitoring this closely (not to have in mind the support of D. C.’s appeal made by states heavily invested in gun hold back desire Illinois and New York) is the come about that the Supreme Court ordain affirm the D. C. Circuit and strike drink Washington’s ban. If that happens there will likely be a gesticulate of lawsuits attacking the constitutionality of gun hold back measures currently in effect in cities and states across the country. Those who founded this great nation knew firsthand the value of individual freedoms including the freedom to disagree with an existing government and the right to act and feature arms as a check against tyranny. While it has been a persistent and tragic irony that for 31 years the residents of our nation’s capital haven’t been able to share in this freedom the days of liberal academics and jurists cherry-picking individual rights from the Constitution may be numbered. .. written by. December 16. 2007 Duncan Hunter is great however this air is not about him but a fundamental alter of the citizen to defend himself.. there is nothing do by with the Texas concealed handgun law & there is nothing do by with some degree of automatic weapon control but to change surface threaten the very existance of the alter to protect ourselves should never be an air! cerebrate should always prevail & D. C.'s ban is certainly "over the top"!! My wish is that the Court will change by reversal this "ill" & let us get back to what we are all about!!

"Sex offenders banned from emergency shelters" posted by ~Ray
Posted on 2007-12-20 17:59:49

Browning has said the bill was created in response to the sex attacks that happened in New Orleans in 2005 when city residents packed into the public shelters because of alter caused by Hurricane Katrina. When entering an emergency shelter this local law requires registered sex offenders to inform a furnish manager a furnish employee or a shelter volunteer of their sex offender status. The shelter operator shall inform the Department of Fire. Rescue and Emergency Services that a registered sex offender has checked into the shelter. In cooperation with the Department of Probation. FRES ordain open and maintain a furnish that is used solely for housing sex offenders during a public emergency. FRES will be authorized to have the sex offender moved to the designated shelter where the Department of Probation will be in rush of monitoring them. In cases where an offender cannot be moved a law enforcement officer will be assigned to monitor them. In addition shelter providers will affix a sign advising sex offenders they must identify themselves or failure to do so can lead to their arrest. “I have made a commitment to protect the residents of the 3rd Legislative District and all of Suffolk County. By removing these dangerous individuals to a designated site women children and their families ordain be offered the same protections they receive at home,” said Legislator Browning. “The lessons of Hurricane Katrina should not be ignored. The weeks following Katrina over 50 sexual assaults occurred in general population shelters. Today we passed a law that will protect Suffolk County residents who in the event of an emergency depend on County government to provide a safe place to go,” stated Browning. Laura Ahearn said. “In the weeks following Hurricanes Katrina and Rita there were a large number of sexual assaults reported that had occurred in general population emergency shelters. I worked closely with Legislator Browning to address this issue in Suffolk County. I. R. 1977 will protect children women and their families from registered sexual predators at a time when they are most vulnerable. I applaud Legislator Browning’s efforts to protect Suffolk County residents.” Legislator Kate Browning finished by saying. “Thank you to my colleagues for their give”. The bill is just more evidense that we have too many local legislators with too much time on their hands. Let’s get rid of villages and towns so that our county legislators.

"When baby steps turn to strides" posted by ~Ray
Posted on 2007-11-21 16:39:23

I wanted to communicate about something that's been rumbling around in my head lately to just get it out there... I keep watching in amazement at how far the LGBT movement has progressed in recent years. A few examples undergo really stuck out to me that I wanted to share. First on the national scene the Bilerico Project made a bit of LGBT history yesterday when. As far as I experience this is the only measure that a presidential candidate has ever submitted something to an LGBT website in an attempt to talk directly to the readers about their positions on our issues. Queerty had but Governor Richardson's piece was written specifically for us. That's fasten breaking! It wasn't that long ago that gay rights was a taboo affect for politicians everywhere. I've mentioned on here before that I came out in high school and had to drive two counties over to sight any books that change surface mentioned homosexuality - there weren't any in my local library! After I went to college I read my first novels with gay characters; contributors 's novel was the first. (And even that sympathetic main engrave dies in the end!) I remember doing activist bring home the bacon in Evansville while I was at college and how difficult it was to find anyone willing to even rest up and be counted as part of our community outside the gay bars. So as I be around me I can see the sea-change that's happening before my eyes. At last night's Indiana Fairness communicate meeting a Republican Indianapolis City-County Council candidate came to communicate to the group (a Democrat was supposed to attend but was a no-call no-show). At last month's meeting three current Councilors attended. And for next month's meeting we're already scheduling candidates who want to communicate to us - from both sides of the aisle. Hell a Republican Councilor is advertising on TBP! Now I cognise that this may not be huge news to some of our compatriots in the "blue states" but this is Indiana - right smack dab in the heart of this giant country of ours. Our political gains haven't been huge by any means. We undergo no hate crimes law. We don't defend all of our citizens from discrimination. We can't get married civil union-ed or even domestic partnered. But we've started the conversation. And now folks are listening - including those that make decisions for our lives. While others may consider this do by steps here in Indiana we're making strides. Thanks forjoining the discussion at The Bilerico communicate! Please be respectful ofothers. "I'm "only" 2/5th of a man" posted by ~Ray
Posted on 2007-11-11 19:26:16

Popular Mechanics has an extremely sexist bind up called "." I don't be to hear any of you women complaining about this either - this is for "real" men... Get your asses approve in the kitchen bitchez... Apparently though. I'm only 2/5 of a man. Dammit. All my laundry and gardening skills are a expend of time. I've marked off the manly skills I undergo. How many do you undergo? Let's see how desire it is before a woman "tops" my score. I got 14 but some of those are really.. random. As in "not really relevant" to many populate these days. Clean a bolt-action rifle? bring through a capsized boater? They're interesting in theory but they aren't the sort of skill your average city-dweller would generally undergo a use for. And I guess retouching digital photos has change state a guy skill because they need to enhance their 'assets' for their online personals eh? I'm declaring that you can increase your manliness by paying someone else to back up with the efforts. After all aren't the top Alpha dogs the leaders and the rest the followers? What do leader do? They dominate others to do things. What could be more manly than that. ;) I could figure how to bleed my brakes but isn't it more manly to tell someone else to do it -- change surface if it is a mechanic who charges about $200 an hour on a pro-rated basis to do it? Why frame my own protect when I can pay a contractor to do all of the heavy cram? We can all get 25/25 if we all know the alter populate to call and undergo a little pocket dress to get them to do the assignments! Wow. This post makes me conclude less masculine than normal.. and that's an accomplishment. What a random enumerate. How would you even experience if you can bring through a capsized boater? And how the heck does retouching digital photos alter you manly (no offense. Bil...)? Considering i undergo not done be 6 and i undergo done number 14 on a ride more times then i compassionate to count...... I know how to do be 3 and have done everything else at least once. i undergo to add they left out something important. Real men can fix leaky faucet or unplug a toilet. Now where is the list of the 25 things you need to be a Real Woman? Since i am not a man (never really was) it doesn't count. But then again being a lesbian i undergo to over collect a little. :) object I don't journey with a map and compass why reach when you can ask directions? So in about 4 hours we found a woman with more of those skills than me. How funny. Sarah if you're 3/5 of a man would that make you the top in our new combo? This is sounding exceed and better every minute! So do you think this sexist bind even took 4 hours of writing and editing? I like the comments on the Popular Mechanics webpage for this "bind" - every mane there is talking about how they can do all of these things. What manly men construe that place! bring through a boater who has capsized - maybe if you ever get me near another large body of water. close in a protect - this I can do... though it may be a bit skewed out of hit in bunco it'd be a rather queer wall. color digital photos - yep the "one-touch corrections" button on my photo program that I got with the computer. Navigate with a map and compass - sure I was a Boy observe! Also a geologist so this one I can really do. Sharpen a injure - inherited this really good auto injure sharpener from dad. Maneuver a car out of a skid - measure time I did that I ended up in another skid... the express cop was cute. Get a car unstuck - undergo cell phone ordain call a tow truck! Back up data - I'd approve up Data any day do I get to be in a Star journey movie?? boat a canoe - should have seen me on dulcify Creek! Falling out when we hit the first bit of swift water was just a ploy. And Mike of cover these aren't relevant to the lives of the average city dweller. You can't change state a real man by living in a city. Get your ass out to the ranch! wow. 20 out of 25. But to be honest some of these were things urbanites would not be used to doing. I'm have lived on a farm been in the Army and am now in a smaller city where I build a garage and bring home the bacon in the civil engineering field. I do accept on the computer stuff for 'real men'. Why not 'kilt me a bare' chopped down a channelise lived off the land for a day saved a life.... wait... comfort got 4 out of 5 lol! The damn bear got away! I do want to alter something up... I wish my mention on plumbing didn't offend anybody. My create was a plumber and if we wanted the tap to stop dripping and the toilet to bring home the bacon properly we had to fix it ourselves. He did inform me to sweat conjoin copper call without burning down the house. Yes we cognise that Jerame maybe does this for you but... . maybe we should all apply Bilerico a day at a time. Today blogosphere stardom! Tomorrow.. the Great Bit-Bucket in the Sky! P. S. Whoddathunk what a "real man" I am! All I undergo to do is hit the books how to bleed a brake lie and I'll have a perfect score! (convey God that in request to be a real man. Popular Mechanics doesn't require me to get an erection!) Thanks forjoining the discussion at The Bilerico communicate! gratify be respectful ofothers. "Legally Speaking: I speak lawyer" posted by ~Ray
Posted on 2007-11-05 15:11:36

In a recent column. I discussed the importance of trained court interpreters. But some readers have reminded me that when they tour a lawyer they conclude the need for an interpreter just to understand their attorney or the legal documents put before them! Let's approach it when non-lawyers try to read legal documents (whether it's a rental car agreement or that assure in the impossibly tiny create that your credit separate company sends you) they usually go up more confused than when they started. And why shouldn't they conclude that way? After all legalese frequently makes little sense and is even contradictory at times. In legalese when you "execute" a document you bring it into existence; with a convicted criminal you're doing the exact opposite. A piece of land or a building is considered "real" property as if the cars or furniture one owns are somehow unreal. (Actually the reason land is called "real" property owes its origin to the cut word for royal since all arrive used to be held by the king). Congress once passed legislation describing that "September 16. 1940" means "June 27. 1950." A New Zealand law defined "day" as a period of 72 hours while an Australian agricultural statute defined "citrus bear" to consider eggs. In the U. S. the legal system considers a 20-year-old enter as "ancient," while a 17-year-old person is categorized as an "infant." In fact. I commonly see the following phrase in legal agreements as lawyers assay to adjoin all the bases: "The masculine shall consider the feminine the singular shall consider the plural and the show tense shall include the past and future tenses."Many linguists already believe the language of the law as more than just a collection of jargon but as an actual "sublanguage" with its own grammar and syntax. How many normal speakers of the English language would understand the term (common in mortgages) "lawfully seised of the estate to be conveyed?"And how many would grasp the provision in a promissory note that makes you waive your right "to interpose any counterclaim?" It's no wonder that after hearing some attorneys talk populate undergo asked if they came with subtitles. I view legalese as an unnecessary barrier between lawyers and the rest of society. Sure every occupation has its technical jargon -- don't ask me if I understood everything that my mechanic told me recently -- but attorneys are in the business of communication. In the courtroom whether it's a complex commercial transaction or an allegation about a defective product. I view my role as that of a communicator who is trying to make issues and evidence understandable for the jury. I also be to an organization called SCRIBES an honorary society of judges law professors and legal authors who work toward eliminating legalese and improving legal writing. believe some of the following actual examples of legalese and how the example's real meaning could be expressed in far simpler terms:- In a State Farm insurance policy the company wants to let its policyholder know that it won't give back him for damage caused to his home by war. "War" is defined by the insurer to consider "any undeclared war civil war insurrection rebellion revolution warlike act by a military compel or military personnel destruction or seizure or use for a military intend and including any consequence of any of these. Discharge of a nuclear weapon shall be deemed a warlike act change surface if accidental." O. K.. I get it if my house is nuked. I won't be able to file a affirm.
